License agreement

GRANT OF LICENSE

FusionCharts Technologies LLP grants you a nonexclusive right to use and distribute FusionCharts for FileMaker and FusionMaps for FileMaker with your FileMaker solutions and applications, subject to the following terms:

• The JavaScript and SWF files present as part of FusionCharts for FileMaker and FusionMaps for FileMaker package can only be used within the application context (Web Viewer Object) of FileMaker, that is, the SWF and JavaScript files cannot be used outside of FileMaker for use in web pages, web applications, web sites, other applications or presentations.
• The SWF and JavaScript files CANNOT be distributed independently of the entire FusionCharts for FileMaker or FusionMaps for FileMaker package.
• If possible, give relevant credits and link backs to our product in your solution or its documentation.

RE-DISTRIBUTION AS A PART OF A PRODUCT/SOFTWARE/APPLICATION

FusionCharts for FileMaker can be redistributed with your FileMaker solutions, subject to the terms below.

• The end product, application or solution is a FileMaker solution itself.
• The SWF and JavaScript files from FusionCharts for FileMaker or FusionMaps for FileMaker is used only within the Web Viewer object of FileMaker.
• Your registration for such distribution has been permitted by FusionCharts. To get permission, please send us an email at support@fusioncharts.com with the following information:
  • Your company name & address
  • Name and description of your product

While not compulsory, we would appreciate a link back from your product website to our website www.fusioncharts.com/extensions/filemaker/

AS-IS DISTRIBUTION

FusionCharts Technologies allows and encourages 3rd parties to distribute and make as many Exact copies as you wish of FusionCharts for FileMaker/FusionMaps for FileMaker and distribute it by Internet, BBS's, Shareware distribution libraries, CD-ROMs, etc provided that the following terms are satisfied:

• Exact copies of the complete software package, and that it is unmodified and individual package and not as a part of any other application/product/software.
• The Software may not be made available on any site, CD-ROM, or with any package which makes available or contains viruses, virus source code, virus construction programs, or virus creation material
• You must disclose that this product is copyrighted by FusionCharts Technologies LLP
• You must not represent in any way that you are selling the software itself

RESTRICTIONS

You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Software.

OWNERSHIP & COPYRIGHT

The Software is owned by FusionCharts Technologies LLP and is protected by international copyright law and treaty provisions. Your license confers no title or ownership in the Software and should not be construed as a sale of any right in the Software. You further acknowledge that title and full ownership rights to the Software will remain the exclusive property of FusionCharts Technologies and you will not acquire any rights to the Software except as expressly set forth in this license. You agree that any copies of the Software will contain the same proprietary notices which appear on and in the Software.

WARRANTY

FusionCharts Technologies expressly disclaims any warranty for the software. THE SOFTWARE AND ANY RELATED DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU.

INDEMNIFICATION

You hereby indemnify and hold harmless FusionCharts Technologies and its affiliates against any loss, liability, damages, costs or expenses suffered or incurred by the Indemnified Parties at any time as a result of any claim, action or proceeding arising out of or relating to your use, operation or damages, costs or expenses which may be suffered or incurred at any time by you as a result of your reliance upon or use of the Software. FUSIONCHARTS TECHNOLOGIES SHALL NOT BE LIABLE FOR DAMAGES OF ANY KIND, INCLUDING GENERAL, DIRECT, SPECIAL, INCIDENTAL AND CONSEQUENTIAL DAMAGES, RESULTING FROM OR ARISING OUT OF THIS AGREEMENT OR YOUR USE OF THE SOFTWARE. TERM AND TERMINATION.
This Agreement shall commence on the Effective Date of installation of software and shall remain in full force and effect until terminated, or through the mutual written consent of the parties (the "Term").
